No vehicle other than a passenger automobile will be authorized to park in any Walters Apartments community, except in an area or areas, if any, specifically designated by management for parking or storing any one or more designated types of “Prohibited Vehicles”.
“Prohibited Vehicles” are strictly prohibited to be parked, stored, or to remain in the Community (except in an area or areas, if any, specifically designated by management for the parking or storing of any one or more designated types of prohibited vehicles). Prohibited Vehicles are vehicles not specifically permitted by the first sentence of this section and include the following: abandoned vehicles, disabled vehicles stored vehicles, motorcycles, boats, boat trailers, campers, trailers of any kind, recreational vehicles, trucks, vehicles primarily used for commercial purposes, and vehicles with commercial writings on their exteriors. Notwithstanding the above, trucks and commercial vehicles will be allowed temporarily in the Walters Apartments communities during normal business hours for the purpose and serving any apartment provided that no such vehicle will be authorized to remain in the Community overnight or for any purpose. This regulation shall not apply to management.
A. Definitions: For the purpose of this provision, the terms used herein are defined as follows:
1. An “abandoned vehicle” will mean a vehicle that is both obviously inoperable or does not have a current license plate, unexpired inspection sticker and/or remains parked in the same spot for fourteen (14) days.
2. A “disabled vehicle” will mean any vehicle either not in current operating condition or without a current registration and/or inspection.
3. A “stored vehicle” will mean any vehicle other than an abandoned vehicle which remains parked in the same spot for fourteen (14) days or which is put on blocks or covered with tarpaulin and remains on blocks or covered overnight.
Pursuant to Division of Motor Vehicle regulations, any motor vehicle violations that exist, local Police Departments will adhere to the law and your vehicle may be removed or cited. This is the law.
B. Procedure: If any vehicle is parked in the Community except as authorized by this section, a notice will be placed on the vehicle designating the provision hereof that is being violated and indicating that after two (2) days the vehicle may be towed. The notice will supply the name and telephone number of the person who will do the towing and setting forth the name and telephone number of a person to contact regarding the alleged violation provided, sin embargo, that in the situation where a vehicle is parked in fire lane or is blocking another vehicle no notice will be required and the vehicle may be towed immediately. If two (2) days after such notice is placed on the vehicle, the violation continues or again occurs, the vehicle may be towed in accordance with the notice, without further notice to the owner or user of the vehicle. Any fee or expense incurred for towing and storage of any vehicle will be paid by owner or user of the vehicle. Notwithstanding anything to the contrary herein, management may elect such other remedies as provided by the law. The resident hereby consents to the towing of any of their vehicles under these circumstances.
